1. Acceptance of Terms

By downloading, installing, or using the OutfitRec mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

OutfitRec is an AI-powered wardrobe assistant that allows you to:

• Photograph and catalog your clothing items
• Receive AI-generated outfit suggestions and critiques
• Track outfits with a calendar diary
• Get weather-based outfit recommendations
• Build and save custom outfit combinations

3. Account Registration

• You must create an account using a valid email address to use the App.
• You are responsible for maintaining the confidentiality of your account credentials.
• You must be at least 14 years old to create an account.
• You are responsible for all activity that occurs under your account.

4. Subscriptions and Payments

4.1 Free Tier

The App offers a free tier with limited AI-powered features (up to 5 AI actions per day, up to 30 closet items).

4.2 Paid Subscriptions

OutfitRec offers three paid subscription plans — Basic, Plus, and Pro — each unlocking higher usage limits and additional features:

• Basic — 15 AI actions per day, up to 75 closet items, all 3 style personas.
• Plus — 40 AI actions per day, up to 200 closet items, all personas, and Style DNA learning.
• Pro — 100 AI actions per day, up to 500 closet items, all personas, Style DNA, and early access to new features.

• Subscriptions are billed on a recurring basis (monthly or yearly, depending on the plan selected) through the Apple App Store or Google Play Store.
• Auto-Renewal: Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date.
• Cancellation: You may cancel your subscription at any time through your device's App Store or Play Store subscription settings. Cancellation takes effect at the end of the current billing period.
• Refunds: Refund requests are handled by Apple or Google according to their respective refund policies.

4.3 Price Changes

We reserve the right to change subscription prices. Any price change will take effect at the start of the next billing period following notice.

5. AI-Generated Content Disclaimer

• Outfit suggestions, critiques, ratings, and clothing analysis are generated by artificial intelligence (Google Gemini).
• AI-generated content is provided for entertainment and informational purposes only. It does not constitute professional fashion advice.
• AI results may be inaccurate, incomplete, or subjective. We make no guarantees about the quality, accuracy, or appropriateness of AI-generated suggestions.
• You use AI-generated content at your own discretion and risk.

6. User Content

6.1 Your Content

• You retain ownership of all photos and data you upload to the App.
• By uploading content, you grant us a limited license to process, store, and transmit your content solely for the purpose of providing the App's services (e.g., sending images to AI for analysis).

6.2 Content Restrictions

You agree to upload only images of clothing items, shoes, and accessories. You must not upload content that:

• Contains images of people, including but not limited to selfies, portraits, or full-body photos — images of minors are strictly prohibited
• Contains nudity, sexually suggestive material, or any form of exploitative content
• Contains violent, graphic, threatening, or hateful imagery
• Infringes on any third party's intellectual property rights
• Contains illegal, harmful, or offensive material
• Contains malware, malicious code, or non-image files
• Is not clothing-related (e.g., screenshots, memes, food, animals, text images)

6.3 Content Moderation

All uploaded images are automatically screened by AI-powered content moderation before being stored. Uploaded images may be temporarily processed or stored to perform automated moderation checks. Content that violates our guidelines will be rejected and promptly deleted. Images that do not meet our content guidelines are rejected and never stored on our servers.

• We reserve the right to review, reject, remove, or delete any content at our sole discretion, with or without notice.
• We may use automated systems and manual review to enforce these content policies.
• Repeated violations may result in immediate account suspension or permanent termination.

7. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose
• Upload, store, or transmit any content that exploits, harms, or endangers minors in any way
• Use the App to store, distribute, or facilitate the distribution of illegal material
• Attempt to circumvent usage limits, rate limiting, content moderation, or anti-abuse protections
• Create multiple accounts to bypass free-tier restrictions or content moderation bans
• Use automated scripts, bots, or scrapers to access the App
• Interfere with or disrupt the App's servers or infrastructure
• Reverse engineer, decompile, or disassemble the App
• Resell, redistribute, or commercially exploit the App's services

8. Intellectual Property

• The App, its design, features, and all related intellectual property are owned by OutfitRec.
• The OutfitRec name, logo, and branding are our trademarks.
• These Terms do not grant you any rights to our intellectual property except the limited right to use the App as intended.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

• THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED.
• WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
• WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP.
• OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP'S SUBSCRIPTION SERVICES IN THE 12 MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses arising from your use of the App, your violation of these Terms, or your violation of any rights of a third party.

11. Account Termination

• You may delete your account at any time through the App's Settings screen or via our account deletion page.
• We may suspend or terminate your account immediately, without prior notice, if you violate these Terms — including but not limited to uploading prohibited content or engaging in abusive behavior.
• We may suspend or terminate accounts and restrict access by IP address for accounts that violate our content policies.
• Banned users are not entitled to refunds for any active subscriptions.
• Upon termination, your right to use the App ceases immediately. Your app data will be deleted in accordance with our Privacy Policy. If you have an active subscription, you must cancel it separately through the App Store or Google Play to avoid continued billing.

12. Reporting and Law Enforcement

• We cooperate fully with law enforcement authorities and may report suspected illegal activity, including but not limited to child exploitation material (CSAM), to the relevant authorities (such as NCMEC, INHOPE, or local law enforcement).
• We may preserve and disclose account information (including email addresses, IP addresses, upload timestamps, and content metadata) when required by law, legal process, or to protect the safety of any person.
• Users can report inappropriate content or abusive accounts by contacting support@outfitrec.app.

13. Changes to These Terms

We may modify these Terms at any time. Material changes will be communicated through the App or via email. Continued use of the App after changes constitutes acceptance of the updated Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Spain, without regard to conflict of law provisions. Any disputes shall be subject to the exclusive jurisdiction of the courts of Spain.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
